BorgBase Terms of Service

Thank you for using BorgBase.

These Terms of Service ("Terms") apply to your use of our website, products, and services. Please read them carefully and let us know if you have any questions. By using BorgBase, you agree to be bound by these Terms. If you're using BorgBase on behalf of an organization, you agree to these Terms on behalf of that organization.

Uploaded Content

Any files you upload to BorgBase belong to you and you are responsible for obtaining relevant licenses. If we learn of prohibited material stored on our service, we reserve the right to remove it.

We encourage you to use encryption to secure any material before it leaves your computer.

Currently two regions are available: EU (European Union) and US (United States and Canada). More regions may be added in the future.

Service Abuse

Please use this service, like a civilized person. If we notice abuse, like excessive requests, excessive data transfer or account sharing, you will be given a warning, after which your account may be terminated if the behavior is not corrected.

Refund Policy

If you are not happy with our service, you can apply for a refund within 30 days for annual packages and 3 days for monthly packages.

Taxation

Based on your location and billing address, the VAT applicable in your country will be added for individual customers and business without a valid VAT number. We will forward all VAT payments to the responsible tax authorities on a quarterly basis.

Unpaid Accounts

If you don't have an active subscription, you can continue using your account as a free trial account, which is subject to lower limits than paid plans. If your account exceeds its data limit for a prolonged period of time, we will delete excess data after attempting to contact you.

Limitation of Liability

BorgBase is designed as an operational backup solution. While we use different measures to protect your data from hardware failure, there is no additional geographic redundancy, i.e. no backup of your backup. As a result it's not suitable as a data archive, where there is no other copy of the file.

To the fullest extent allowed by law, BorgBase (and Peakford Ltd) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from (A) your access to, use of, inability to access, or inability to use our service; (B) any third party conduct or content on BorgBase, including any defamatory, offensive, or illegal conduct of third parties; or (C) any unauthorized access, use, or alteration of your content.

Linked Products and Services

We are proud to be part of a wider community, which includes different open source projects and complementary services. Sites that we link to may contain links to websites, services, and advertisements that we neither own nor control. We don't endorse or assume responsibility for any third-party sites, information, materials, products, or services.

Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and BorgBase. If any provision of these Terms is found to be unenforceable, the remaining provisions of these Terms will remain in full force and effect.

Modification

The Terms may be modified from time to time. If we make changes that we believe will substantially alter your rights, we will notify you. You'll agree to accept any changes or revisions to the Terms by continuing to use our service.
